This Legal Notice, Disclaimer, and Terms & Conditions (“Agreement”) govern your access to and use of InfinityX.trade (“InfinityX”, “Platform”, “Company”, “We”, “Us”, “Our”), including all websites, applications, dashboards, APIs, software, tools, content, and services provided therein.

By accessing, registering for, or using the Platform in any manner, you acknowledge that you have read, understood, and agree to be bound by this Agreement in its entirety.

If you do not agree with any part of this Agreement, you must immediately discontinue use of the Platform.

2. NATURE OF THE PLATFORM (NON-ADVISORY DECLARATION)

InfinityX is a technology and automation platform that provides:

• Algorithmic and automated trading tools
• Trade execution automation via third-party exchange APIs
• Analytical dashboards and performance reporting
• Rule-based AI risk control and validation systems, including Tathastu™ AI

InfinityX does NOT:

• Provide investment advice
• Provide buy/sell recommendations or “tips”
• Provide personalized financial advice
• Act as a broker, dealer, intermediary, or exchange
• Act as a portfolio manager or discretionary manager
• Guarantee profits, returns, or capital protection

All tools and services are provided strictly on an execution, automation, and informational basis.

3. INDIA-SPECIFIC REGULATORY DISCLAIMER (SEBI-SAFE)

For users located in India:

InfinityX is NOT registered with the Securities and Exchange Board of India (SEBI) as:

• An Investment Adviser (IA)
• A Research Analyst (RA)
• A Portfolio Management Service (PMS)

Nothing on InfinityX shall be construed as:

• Investment advice under the SEBI (Investment Advisers) Regulations
• Research reports under the SEBI (Research Analysts) Regulations
• Portfolio management services under SEBI regulations

All tools, analytics, automation systems, and AI features are provided solely for educational, analytical, and automation purposes.

4. GLOBAL USERS DISCLAIMER

For users outside India: InfinityX does not provide investment, financial, legal, or tax advice under the laws of any jurisdiction.

You are solely responsible for determining whether your use of the Platform is legal in your country or region and for complying with all applicable laws, regulations, and exchange rules.

5. RISK DISCLOSURE (MANDATORY)

Trading in financial markets—including cryptocurrencies, derivatives, and leveraged instruments—involves substantial risk and is not suitable for all users.

Risks include, but are not limited to:

• Market volatility and sudden price movements
• Liquidity risk and slippage
• Leverage risk
• Technology failures
• API errors or limitations
• Exchange outages or maintenance
• Regulatory changes
• Force majeure events

You may suffer partial or total loss of capital.

InfinityX, including all automation tools and AI systems, does not guarantee:

• Profits or positive returns
• Accuracy of signals or analytics
• Capital preservation
• Consistent or repeatable performance

Past performance, simulations, backtests, or examples are not indicative of future results and are provided for illustrative purposes only.

7. TATHASTU™ AI — SPECIFIC DISCLAIMER

Tathastu™ AI is a rule-based, algorithmic risk-control and validation engine designed to:

• Enforce predefined risk limits
• Validate trades against probability and exposure rules
• Reduce over-trading and drawdown risk

Tathastu™ AI does NOT:

• Predict markets with certainty
• Eliminate trading risk
• Make discretionary or emotional decisions
• Override market behavior
• Guarantee outcomes or profits

All actions performed by Tathastu™ AI are based strictly on predefined logic, user configurations, and system parameters.

8. USER RESPONSIBILITIES

• All trading decisions and outcomes
• Configuration of strategies and risk parameters
• API key permissions and security
• Monitoring your trading activity and balances
• Understanding platform functionality
• Compliance with applicable laws and regulations

InfinityX is not responsible for losses resulting from user error, misunderstanding, or misconfiguration.

9. THIRD-PARTY SERVICES & DEPENDENCIES

InfinityX integrates with third-party exchanges, APIs, data providers, and infrastructure. InfinityX shall not be liable for losses or damages arising from exchange downtime, API changes, network latency, liquidity constraints, or third-party service interruptions.

10. LIMITATION OF LIABILITY

To the maximum extent permitted by law, InfinityX and its affiliates shall not be liable for direct or indirect damages, trading losses, data inaccuracies, or system failures. Use of the Platform is entirely at your own risk.

11. INTELLECTUAL PROPERTY

All software, algorithms, AI models, branding, and content are the exclusive intellectual property of InfinityX. Unauthorized use is strictly prohibited.

12. SUSPENSION & TERMINATION

InfinityX reserves the right to suspend or terminate access without notice if this Agreement is violated or required by law.

13. MODIFICATIONS TO TERMS

InfinityX may update this Agreement at any time. Continued use constitutes acceptance of revised terms.

14. GOVERNING LAW & JURISDICTION

This Agreement shall be governed by applicable laws of the Company’s operating jurisdiction.

15. FINAL ACKNOWLEDGEMENT

• You understand the risks of trading
• You acknowledge that no profits are guaranteed
• You accept full responsibility for your actions
• You agree to all terms stated herein
